Brussels files for Spain to eliminate restrictions on the sale of European pyrotechnics in its market The European Commission has filed this Thursday to Spain to eliminate the additional requirements imposed on pyrotechnic articles from other countries of the European Union, considering that it is a restriction on the free movement within the Community space of goods that are already legal rights in the EU. The European Union already has common standards that, according to Brussels, guarantee a "high level of protection" of consumer health and public safety, so it does not see it necessary for Spain to force additional requirements to market European pyrotechnics in your market. Spanish legislation requires registration of these products before importation, transfer, storage and distribution in Spain, in addition to obtaining a circulation permit from the Spanish authorities. Thus, the Commission believes that the Spanish rules are contrary to the directive on pyrotechnic articles and the Single Market, since a product marketed legally in another Member State "must be able to circulate freely throughout the EU". "Spanish national restrictions duplicate controls already carried out in another Member State," Brussels criticizes in a statement. The opening of the file takes the form of a letter of location - the first step in the infringement procedure - which Brussels has sent to the Government to clarify the situation within two months and provide clear information on the corrective measures has started. If the community services did not consider the explanations of Spain to be good, they could proceed to the second phase of the file, a reasoned opinion that gives the Member State another two months to correct the problem, after which the Commission could take the case to the Court. of Justice of the European Union (TEU). |
